Terms of Service

By accessing our website, requesting a quote, or placing an order with OurPCB Australia PTY LTD ("OurPCB", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any part of these terms, you may not use our services.

OurPCB Australia provides:

• Custom cable assembly manufacturing
• Wire harness design and production
• Overmolding and connector assembly services
• Prototyping and small-batch production
• Quality testing and certification services
• Technical consultation and engineering support

All services are subject to our capabilities, capacity, and acceptance of your order.

3.1 Quotations

• All quotations are valid for 30 days from the date of issue unless otherwise stated
• Quotes are subject to change if specifications, quantities, or requirements change
• Quotations are provided in Australian Dollars (AUD) unless specified otherwise
• Prices include GST unless stated as "excluding GST"

3.2 Order Acceptance

• An order is only accepted when we issue a written order confirmation
• We reserve the right to refuse or cancel any order at our discretion
• Minimum order quantities (MOQ) apply: typically 10 units for prototypes, 100 units for production
• Custom orders may require tooling fees or setup charges

4.1 Standard Payment Terms

• New Customers: 30% deposit upon order confirmation, 70% balance before shipment
• Established Customers: Net 30 days from invoice date (subject to credit approval)
• Prototypes: 100% payment in advance
• Large Orders: Custom payment milestones may be negotiated

4.2 Accepted Payment Methods

• Bank transfer (EFT/Wire transfer)
• Credit card (Visa, Mastercard, Amex)
• PayPal (for orders under AUD $5,000)
• Purchase orders (approved accounts only)

4.3 Late Payments

Overdue accounts may be subject to:

• Interest charges of 1.5% per month on outstanding balances
• Suspension of services until payment is received
• Debt collection and legal action (customer liable for all costs)

5.1 Lead Times

• Prototypes: 3-5 business days
• Small Batch (100-500 units): 10-15 business days
• Volume Production (1000+ units): 3-4 weeks

Lead times are estimates and may vary based on:

• Product complexity and specifications
• Material availability
• Production capacity and current workload
• Custom tooling requirements

5.2 Shipping

• Domestic Australia: 1-3 business days (Melbourne/Sydney), 2-5 days (other cities)
• Shipping costs are additional unless stated otherwise in the quote
• Risk passes to the customer upon delivery to the carrier
• We are not liable for carrier delays or damages during transit (insurance recommended)

6.1 Product Warranty

We warrant that our products will:

• Be free from defects in materials and workmanship for 12 months from delivery
• Conform to the agreed specifications and drawings
• Be manufactured in accordance with ISO 9001:2015 and IATF 16949 standards

6.2 Warranty Exclusions

Our warranty does NOT cover:

• Normal wear and tear
• Misuse, abuse, or improper installation
• Modifications or repairs by unauthorized parties
• Damage from accidents, environmental factors, or force majeure
• Products used outside specified parameters

6.3 Warranty Claims

To make a warranty claim:

• Notify us within 7 days of discovering the defect
• Provide proof of purchase and detailed description of the issue
• Return defective products for inspection (freight at our cost for valid claims)
• We will repair, replace, or refund at our discretion

To the maximum extent permitted by Australian law:

• Our total liability for any claim is limited to the purchase price of the affected products
• We are not liable for indirect, consequential, or incidental damages including:
  • Loss of profits or revenue
  • Loss of data or business interruption
  • Cost of replacement goods or services
  • Damage to reputation or goodwill
• We are not liable for delays or failures due to circumstances beyond our reasonable control

Nothing in these terms excludes or limits rights granted by the Australian Consumer Law that cannot be excluded or limited.

8.1 Customer Designs

• You retain all intellectual property rights in your designs and specifications
• We will treat your designs as confidential information
• We will not manufacture your designs for third parties without your written consent

8.2 OurPCB Property

• All tooling, fixtures, and manufacturing processes developed by us remain our property
• Website content, logos, and marketing materials are protected by copyright
• You may not use our intellectual property without written permission

9.1 Order Cancellations

• Orders may be cancelled before production begins with no penalty
• Once production has started, cancellations incur a fee of 30-50% of the order value
• Custom tooling fees are non-refundable

9.2 Returns

• Defective Products: Full refund or replacement within warranty period
• Wrong Item Shipped: We'll cover return shipping and send correct items
• Change of Mind: Custom products are not eligible for return
• Standard Products: May be returned within 14 days (20% restocking fee applies)

These Terms of Service are governed by the laws of Victoria, Australia.

10.1 Dispute Resolution

• In the event of a dispute, parties agree to first attempt resolution through good faith negotiation
• If negotiation fails, disputes may be referred to mediation
• Legal proceedings must be brought in the courts of Victoria, Australia

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
